Oppose HB 2357 - Keep schools safe for all

HB 2357 purports to protect the religious freedom of Arizona's K-12 students.  Yet, the constitutional rights of every student are already protected.  Students have the right to free speech and expression, including religious expression. When we have NO budget passed why are we wasting valuable time working on protecting freedoms that are already protected?  There is no age limit on free speech. 

In fact, as it is currently written, HB 2357 leaves open the possibility for a school's anti-harassment, anti-bullying or non-discrimination policies to be invalidated.  Although the backers of the bill say this is not the intent, and that this bill does not add any restrictions to school officials, and is only meant to clarify existing laws it will in fact do just the opposite.

Is a time when this state faces some of the most difficult problems of our time, with no budget in sight, the right time to pass legislation that on the surface changes nothing?

 

Although the Senate is not currently hearing bills, we need to send a strong message now to defeat HB 2357.  Let your State Senator know that you oppose HB 2357.

Sample Letter for Campaign

Subject: Please oppose HB 2357

Dear [ Decision Maker ] ,

On the surface, HB 2357 seems harmless. However, in its current form, it is very dangerous.

80% of Arizona voters support anti-bullying and harassment protections for students.

HB 2357, as it is currently written, leaves open the possibility that a school's anti-harassment, anti-bullying and non-discrimination policies will be invalidated.

Additionally, the bill will likely create a wave of litigation that school districts will have to defend themselves against.

With school district already being financially-strapped, we shouldn't be opening up for the door for more costly lawsuits at taxpayer expense.

The religious rights that are intended to be protected in this bill already exist under the US Constitution. This bill actually creates special protections and possibly gives legal sanction to discrimination and harassment.

As your constituent, I urge you to vote NO on HB 2357.

Background Information

If HB 2357 were to become law, school districts would face costly lawsuits, taking away funding for education from already strapped school budgets.  It creates a situation where school officials will have to decide to favor one student's rights over another, and possibly invalidate existing anti-bullying, harassment and discrimination policies.
